Knowing the Rules So You Don't Have To

California's wrongful death statutes and procedural rules are complicated. To preserve your right to make a claim, contact an attorney as soon as possible.

  • In most cases of wrongful death, a lawsuit must be filed within two years of the date of the death.
  • In cases that involve medical negligence or malpractice, you may have as little as one year in which to file your wrongful death lawsuit
  • If a government entity contributed in some way to the wrongful death of your loved one, you must generally file a government tort claim within six months. However, you may also have as little as 30 days in which to notify the government entity of your intent to file a claim.
  • If the plaintiff in a wrongful death lawsuit is a minor, the statute of limitations may be suspended until the child reaches the age of 18.
